Terms and Conditions

Last updated: 24 September 2026

These Terms and Conditions apply to every offer, order and agreement between TOLS Clothing and consumers who buy from our online store at tols.store. Please read them before you place an order.

1. About Us

TOLS Clothing is a Netherlands-based creative brand that designs original graphics and text for garments and accessories. Our full business details are listed in Section 18.

2. Definitions

In these Terms:

•       “TOLS”, “we”, “us” or “our” means TOLS Clothing.

•       “Customer”, “you” or “your” means a consumer: a natural person who buys from us for purposes outside their trade, business, craft or profession.

•       “Business Days” means Monday to Friday, excluding public holidays in the Netherlands.

•       “Withdrawal period” means the 14-day period in which you can withdraw from the contract (see Section 8).

3. Applicability

3.1 These Terms apply to all offers, orders and agreements concluded between you and TOLS through our website.

3.2 These Terms are available on our website before you place an order, so you can read, save and print them. The version in force on the date of your order applies to that order.

3.3 If any provision of these Terms is void or annulled, the remaining provisions continue to apply.

4. How Your Order Is Concluded

4.1 To place an order, you choose your product(s), add them to your cart, go to checkout, enter your details and review your order. Until you place the order, you can correct any input errors in the cart or at checkout.

4.2 You place your order by clicking the final button at checkout, which makes clear that the order involves an obligation to pay.

4.3 The contract is concluded when we confirm your order by email. The confirmation contains the details of your order.

4.4 The contract is concluded in English.

5. Products

5.1 All designs and text on our products are original creations owned by TOLS.

5.2 Every product is made to order by our production partner after you place your order. We do not hold stock, and product availability may change without notice.

5.3 Because each item is printed individually, small variations in colour or print placement compared to the pictures on our website may occur. This does not affect your rights if a product does not conform to the contract (see Section 10).

5.4 Obvious mistakes or errors in our offer (for example, a clearly incorrect price) do not bind us.

6. Prices and Payment

6.1 All prices are shown in euros (€) and include VAT. Any shipping costs are shown at checkout before you place your order.

6.2 Payment is made at checkout using one of the payment methods offered there.

6.3 Our checkout asks for payment in full when you place your order. Nothing in these Terms affects your statutory right under Dutch law not to be required to pay more than half of the price in advance.

6.4 We may change our prices at any time. Price changes do not affect orders we have already confirmed.

7. Production and Delivery

7.1 We deliver only to addresses in the Netherlands. Customers from any country are welcome to order for delivery to an address in the Netherlands, on the same terms and at the same prices.

7.2 Production typically takes 1–5 Business Days, followed by delivery. Estimated delivery times are set out in our Shipping Policy. These are estimates, not fixed deadlines.

7.3 Unless we have agreed a different delivery date with you, we will deliver your order no later than 30 days after the contract is concluded. If we do not deliver in time, you may give us a reasonable additional period to deliver. If we still do not deliver within that period, you may cancel the order and we will refund all payments without undue delay. If delivery on a specific date was essential and agreed, you may cancel immediately.

7.4 The risk of loss of or damage to the products passes to you only when the products have been delivered to you or to a person you have designated (other than the carrier).

7.5 We will email you tracking information as soon as your order ships.

8. Right of Withdrawal

8.1 You have the right to withdraw from the contract within 14 days without giving any reason.

8.2 The withdrawal period expires 14 days after the day on which you, or a third party you have designated (other than the carrier), receive the product. If your order is delivered in several parcels, the period expires 14 days after you receive the last parcel.

8.3 You can exercise your right of withdrawal in either of these ways:

•       Online withdrawal function: use the “Withdraw from contract here” link on our website (in the footer of every page). No account or login is needed. You fill in your name, order number and email address and confirm your withdrawal in a second step. You will immediately receive an email confirming receipt of your withdrawal, with the date and time. This function is available throughout the withdrawal period, in line with Article 6:230oa of the Dutch Civil Code.

•       Through our contact form: send us a clear statement that you are withdrawing from the contract via contact form. You may use the EU model withdrawal form, but this is not required.

8.4 To meet the withdrawal deadline, it is enough to send your withdrawal before the withdrawal period has expired.

8.5 You must send the product back within 14 days after the day on which you informed us of your withdrawal. We will email you the return address.

8.6 During the withdrawal period, you may handle and try on the product as you would in a shop, to establish its nature, characteristics and fit. You are only liable for any diminished value of the product resulting from handling beyond what is necessary for that purpose (for example, wearing it out, washing it or damaging it).

8.7 You bear the direct cost of returning the product, unless the product is faulty or incorrect.

8.8 We will refund all payments received from you, including the standard delivery costs, without undue delay and at the latest within 14 days of the day on which we receive your withdrawal. We do not refund the supplementary cost of a delivery method more expensive than our standard delivery. We may withhold the refund until we have received the product back or you have provided proof that you have sent it back, whichever is earlier.

8.9 We refund using the same payment method you used for your order, unless you have expressly agreed otherwise. You will not be charged any fees for the refund. We will only issue store credit instead of a refund if you expressly ask for it.

9. Exceptions to the Right of Withdrawal

All our products are pre-designed and are not made to your personal specifications. The right of withdrawal therefore applies to all our products, including sale and discounted items.

10. Conformity and Legal Guarantee

10.1 Every product must conform to the contract: it must have the characteristics you may reasonably expect for normal use, based on its description, nature and price.

10.2 Dutch law does not set a fixed guarantee period. A product must last as long as you can reasonably expect. Your statutory rights are at least as extensive as the EU legal guarantee of conformity summarised in the EU legal guarantee notice on our website.

10.3 If a defect becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the product or the defect.

10.4 Please notify us of a defect within a reasonable time after you discover it. Notification within two months of discovery is always on time.

10.5 If a product is faulty, damaged on arrival or not what you ordered, you are entitled to a free replacement (or repair). If that is not possible or not reasonable, you are entitled to a price reduction or to end the contract and receive a full refund, including the standard delivery costs. We cover the cost of any return shipping.

10.6 To help us resolve your claim quickly, please send us your order number, photos of the issue and a short description. Normal wear and tear, and damage caused by not following the care instructions, are not defects.

11. Intellectual Property

11.1 All content, images and designs on our website and products are the intellectual property of TOLS.

11.2 You may not copy, reproduce, modify, distribute or use any part of our content for commercial purposes without our prior written permission.

12. Liability

12.1 We are not liable for indirect or consequential damage, such as loss of profit, business interruption or data loss.

12.2 Our liability for direct damage is limited to the total amount you paid for the order concerned.

12.3 The limitations in 12.1 and 12.2 do not apply if the damage is caused by intent or deliberate recklessness on our part, to death or personal injury, or to our liability under the statutory rules on product liability.

12.4 Nothing in these Terms limits your mandatory statutory rights as a consumer.

13. Privacy and Data

13.1 We process your personal data in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR).

13.2 We only share your data with third parties where needed to process and deliver your order or as described in our Privacy Policy (for example, our production partner, carriers and payment service providers).

14. Complaints

14.1 If you have a complaint, please contact us through our contact form at contact form, describing the issue as fully as possible. We will respond within 14 days of receiving your complaint.

14.2 We are not affiliated with an alternative dispute resolution (ADR) body. If we cannot resolve a complaint together, we will tell you whether we are willing to use a certified ADR body. You may also take your dispute to the competent court (see Section 16).

15. Force Majeure

We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, strikes, pandemics or carrier disruptions. This does not affect your right to cancel and receive a refund if we do not deliver within the period set out in Section 7.3.

16. Governing Law and Competent Court

16.1 These Terms and all contracts with TOLS are governed by Dutch law.

16.2 Disputes will be submitted to the court that is competent under the law. As a consumer, you can always bring a claim before the court of the place where you live.

17. Changes to These Terms

17.1 We may update these Terms from time to time. Updated Terms are published on our website with the date they take effect.

17.2 Changes only apply to orders placed after the new version takes effect. Your order is always governed by the version in force on the date you placed it.
