These Terms and Conditions govern the use of the website and services provided by Tales of a Lost Species (TOLS), a design brand based in the Netherlands. By purchasing from our store or using our website, you agree to be bound by these Terms.

1. About Us

Tales of a Lost Species (TOLS) is a Netherlands-based creative brand that designs original graphics and text for garments and accessories. Our products are printed and shipped through third-party print-on-demand providers, specifically TPOP and Printify (“POD Suppliers”).

2. Definitions

In these Terms:

  • “TOLS”, “we”, “us”, or “our” refers to Tales of a Lost Species.
  • “Customer”, “you”, or “your” means any person who purchases products from us.
  • “POD Supplier” means our third-party print-on-demand fulfillment partners, TPOP and Printify.
  • “Business Days” means Monday to Friday, excluding public holidays in the Netherlands.

3. Applicability

These Terms apply to all offers, orders, and agreements concluded between you and TOLS through our website. By placing an order, you confirm you’ve read, understood, and agreed to these Terms.

4. Products and Availability

All designs and text on our products are original creations owned by TOLS. Product availability may vary and is subject to change without notice. Because all products are made-to-order through POD Suppliers, we do not hold stock.

5. Prices and Payment

5.1 All prices are listed in local currency and include applicable VAT, unless otherwise stated.
 5.2 Payment must be made in full at checkout using accepted payment methods.
5.3 TOLS reserves the right to change prices at any time. Such changes do not affect orders already confirmed.

6. Order Processing

6.1 Once payment is received, your order will be sent to our POD Supplier for fulfillment.
 6.2 Production typically begins within 2–4 business days.
6.3 As products are made-to-order, modifications or cancellations are not possible after payment.

7. Shipping & Delivery

7.1 TOLS ships exclusively within the European Union via our POD Suppliers.
 7.2 Estimated delivery time is:

  • Production: 2–4 business days.
  • Shipping: 3–10 business days within the EU.

7.3 Tracking information will be provided via email once available.
 7.4 Delivery times are estimates only and may vary due to courier delays or holidays.
7.5 We are not liable for delays beyond our control, including customs inspections or courier disruptions.

8. Right of Withdrawal (Cooling-Off Period)

8.1 EU customers have a 14-day statutory right of withdrawal without giving reason.
 8.2 The withdrawal period expires 14 days after you (or a third party on your behalf) receive the product.
 8.3 To exercise this right, you must notify us clearly by email within the 14-day window.
 8.4 You must return the product within 14 days of this notice.
 8.5 Products must be unused, unwashed, and returned in their original condition.
 8.6 You are responsible for the cost of return shipping unless the product is faulty or incorrect.
 8.7 Upon receipt of the return, TOLS will refund:

  • The product price
  • The standard outbound shipping cost

8.8 We do not refund return shipping (unless defective) or any upgraded delivery costs.

9. Exceptions to Withdrawal

9.1 Because our products are made-to-order but not customized per customer request, the right of withdrawal under EU law still applies.
9.2 We do not sell personalized products that would be exempt from withdrawal.

10. Faulty or Incorrect Goods

10.1 If your item arrives damaged, defective, or different from what you ordered, contact us within 14 days of delivery with photos and a clear description.
 10.2 In such cases, we will:

  • Offer a replacement or full refund, and
  • Cover return shipping costs (if applicable).

11. Legal Warranty

11.1 EU customers are entitled to a 2-year statutory warranty for goods that do not conform to the contract.
 11.2 This includes defects that existed at delivery or that emerge within two years under normal use.
11.3 If your item is defective, contact us promptly with your order details and a photo.

12. Intellectual Property

12.1 All content, images, and designs on our website and products are the intellectual property of TOLS.
12.2 You may not copy, reproduce, modify, distribute, or use any part of our content for commercial or personal gain without prior written permission.

13. Limitation of Liability

13.1 TOLS is not liable for indirect, incidental, or consequential damages, including but not limited to:

  • Loss of profits
  • Business interruption
  • Data loss

13.2 Our liability for direct damages shall not exceed the total amount paid by you for the relevant order.
13.3 Nothing in these Terms limits your statutory rights under EU or Dutch consumer protection laws.

14. Privacy and Data

14.1 We handle your data in accordance with our Privacy Policy.
 14.2 We only share your data with third parties when necessary to fulfill your order (e.g., payment processors, POD Suppliers).
 14.3 We comply with the EU General Data Protection Regulation (GDPR) to protect your privacy rights.

15. Complaints & Dispute Resolution

15.1 If you have a concern or complaint, please contact us so we can try to resolve it quickly and fairly.
 15.2 If we cannot reach a resolution, you may submit your complaint through the European Commission’s Online Dispute Resolution platform:

16. Force Majeure

TOLS is not responsible for delays or failures caused by events outside our control, including but not limited to natural disasters, strikes, pandemics, or shipping disruptions.

17. Governing Law and Disputes

17.1 These Terms are governed by the laws of the Netherlands, including the Dutch Civil Code and applicable EU consumer law.
 17.2 Any disputes will be submitted to the competent court in Amsterdam, unless mandatory provisions state otherwise.

18. Changes to These Terms

18.1 We may update these Terms occasionally. Changes will be published on our website with the effective date.
18.2 Continued use of our website or services after updates means you accept the revised Terms.
